1. Acceptance of Terms

By registering for an account or using any part of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Platform on behalf of an organization (such as a club, academy, or agency), you represent that you have the authority to bind that organization to these Terms.

2. About eScoutia

eScoutia is a discovery and networking platform that connects football (soccer) players with scouts, coaches, and clubs. We provide tools for players to showcase their profiles and highlight videos, and for scouts and coaches to search, evaluate, and request introductions to players.

eScoutia is not a talent agency, players' agent, or employment service, and we do not represent players in contract negotiations. We do not guarantee trials, contracts, transfers, or any other outcome. Any agreement reached between a player and a scout, coach, club, or agent is strictly between those parties, and eScoutia is not a party to it and bears no responsibility for its terms or performance.

3. Eligibility and Account Registration

You must be at least 16 years old to create an account. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian is aware of and consents to your use of the Platform, and, where applicable, has reviewed the information included in your profile.

You agree to provide accurate, current, and complete information when creating your account and to keep that information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Each person may maintain only one account, and accounts may not be transferred or sold.

4. Player and Scout/Coach Roles

The Platform supports distinct account types, including Players and Scouts/Coaches, each with different features and visibility. You must select the role that accurately reflects your relationship to football and may not misrepresent your role, affiliation, or credentials.

Scouts and coaches agree to use player information solely for legitimate talent-evaluation and recruitment purposes, and not to harass, misrepresent themselves to, or make misleading promises to players or their guardians.

5. Profile Verification

Players and scouts/coaches may request verification of their profile to obtain a "verified" badge. As part of this process, you may be asked to upload supporting documents (such as identification, licenses, coaching or scouting credentials, club affiliations, or similar proof).

You confirm that any document you upload is genuine, unaltered, and belongs to you. Submitting false, forged, or misleading documents is a violation of these Terms and may result in suspension or termination of your account. Verification documents are reviewed by our team and are permanently deleted from our storage once a decision has been made, as described in our Privacy Policy.

6. User Content and Conduct

You are solely responsible for the content you upload or submit to the Platform, including profile information, photos, videos, and messages ("User Content"). You represent that you own or have the necessary rights to any User Content you submit, and that it does not infringe the rights of any third party.

You agree not to: (a) upload content that is false, defamatory, obscene, or infringing; (b) impersonate any person or entity; (c) harass, abuse, or harm another user; (d) upload malicious code or attempt to interfere with the Platform's operation; or (e) use automated means (such as scraping or bots) to access or collect data from the Platform without our prior written consent.

We reserve the right, but do not assume the obligation, to review, remove, or restrict access to any User Content that we believe, in our sole discretion, violates these Terms or is otherwise objectionable.

7. Introductions and Communications Between Users

The Platform facilitates introductions between scouts/coaches and players, including by email. eScoutia does not verify the accuracy of statements made by users during these communications and is not responsible for the outcome of any interaction, meeting, trial, or agreement arising from an introduction made through the Platform.

You agree to conduct yourself professionally and lawfully in all communications with other users, and to comply with applicable laws regarding the protection of minors where a player is a minor.

8. Subscriptions and Fees

The Platform is currently offered free of charge during our launch period. We may introduce paid subscription plans with additional features in the future. If we do, we will provide clear notice of applicable fees before any charge is made, and continued use of paid features will be subject to the pricing and billing terms presented at that time.

9. Intellectual Property

The Platform, including its design, software, graphics, logos, and trademarks (excluding User Content), is owned by eScoutia or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our prior written consent.

By submitting User Content, you grant eScoutia a non-exclusive, worldwide, royalty-free license to host, store, display, and use that content solely for the purpose of operating and promoting the Platform (for example, displaying your profile to scouts). You retain ownership of your User Content.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PLAYER WILL BE DISCOVERED, CONTACTED, OR OFFERED A TRIAL OR CONTRACT AS A RESULT OF USING THE PLATFORM.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESCOUTIA AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, OPPORTUNITIES, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT, IF ANY, YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Termination

You may stop using the Platform and request deletion of your account at any time by contacting us. We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, provided false information, or engaged in conduct that harms other users or the Platform.

13. Governing Law

These Terms are governed by the laws applicable in the province or country where eScoutia's operating entity is established, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction, unless otherwise required by applicable consumer-protection law.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Platform or applicable law. If we make material changes, we will provide reasonable notice, such as by posting an update on this page or notifying you through the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
